TERMS AND CONDITIONS OF THE ONLINE SHOP www.GrandDeco.pl
of 20th February 2012

I. Definitions
The terms used in these Terms and Conditions mean:
1. Client – a natural or a legal person who places an Order in the Shop or an organization without legal personality, which is given legal capacity by specific provisions;
2. Polish Civil Code - Act of 23 April 1964 (Journal of Laws No. 16, item. 93 with further amendments) established in Poland;
3. Terms and Conditions – terms and conditions for providing online services using the GrandDeco Online Shop;
4. Online shop (Shop) – a website available at www.granddeco.pl through which a Client may in particular place orders;
5. Goods - products available in the Online Shop;
6. Sales Agreement – an agreement for the sale of goods under the Civil Code, concluded between LEDIT Sylwia Lechowska Advertising and Publishing Agency based in 60- 082 Tarnowo Podgórne, Swadzim, ul. Ogrodowa 11, NIP (TAX no.) 973-033-33-51, and the Client. This Agreement is concluded using the Online Shop;
7. Act on special conditions of consumer sale - Act of 27 July 2002 on special conditions of consumer sale and on amendments to the Polish Civil Code (Journal of Laws No. 141, item 176 with further amendments)
8. Act on electronic services - Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204 with further amendments)
9. Order - Client declaration of intent aimed at directly conluding the sales agreement, specifying in particular the type and quantity of Goods.
10. Seller - LEDIT Sylwia Lechowska Advertising and Publishing Agency based in 60-082 Tarnowo Podgórne, Swadzim, ul. Ogrodowa 11, NIP (Tax no.) 973-033-33-51.

II. General Provisions
2.1. These Terms and Conditions determine the rules for the use of the Online Shop available at www.GrandDeco.pl
2.2. These Terms and Conditions include rules referred to in art. 8 of the Act on Electronic Services.
2.3. The online shop, available at www.GrandDeco.pl, is managed by LEDIT Sylwia Lechowska Advertising and Publishing Agency based in 60-082 Tarnowo Podgórne, Swadzim, ul. Ogrodowa 11, NIP (Tax no.) 973-033-33-51
2.4. These Terms and Conditions shall determine in particular:
a) rules for the registration and use of the account in the online shop;
b) conditions and rules for making electronic reservations of products available in the online shop;
c) terms and conditions for placing electronic orders in the Shop;
d) rules for concluding Sales Agreements with the use of the services provided within the Online Shop.
2.5. The online shop can be used provided that the Client’s computer operating system meets the following minimum technical requirements:
a) Internet Explorer 8.0 or later with Java and Adobe Flash.
b) Firefox 3.6 or later with Java and Adobe Flash.
 c) a minimum screen resolution of 1024 x 768 pixels.
2.6. In order to use the online shop the Client should have access to a computer or other equipment having access to the Internet.
2.7. In accordance with the applicable laws, the Seller reserves the right to limit the provision of services thorugh the online Shop for those under 18. In this case, potential customers shall be notified about it.
2.8. Customers can get access to these Terms and Conditions at any time through a link found on the main website www.granddeco.pl and download and print these Terms and Conditions.
2.9. Information on Goods listed on the website of the Shop, in particular, their descriptions, technical and performance features as well as prices, consitutues an invitation to conclude an agreement, within the meaning of the art. 71 of the Civil Code.

III. Terms of use of the Online Shop
3.1. Registration in the Shop is the condition for the commencement of the use of the Online Shop.
3.2. Registration takes place through the completion and acceptance of the registration form available on one website of the Online Shop.
3.3. In order to register the Client shall agree the content of these Terms and Regulations and provide personal information marked as mandatory.
3.4. The Seller may deprive the Client of the right to use the online Shop as well as may limit his access to some parts of or the whole Online Store with immediate effect, if the Client breaches the following Terms and Conditions and, in particular, if the Client:
a) submitted, during the process of registration, data which is false, inaccurate, outdated, misleading or violate the right of third parties,
b) through the online store infringed moral rights of third parties, in particular moral rights of other clients of the Online Shop,
c) commits other acts that are considered by the Seller as acts inconsistent with applicable provisions of law or general principles of using the Internet or acts detrimental to the good name of the Seller.
3.5. A person who is deprived of the right to use the Online Shop can not register again without prior consent of the Seller.
3.6. In order to ensure security of transmission of messages and data related to the services rendered within the Website, the Online Shop shall take technical and organizational measures appropriate to the degree of service safety, in particular measures aimed at preventing acquisition and modification of personal information on the Internet by unauthorized persons.
3.7. The Client is obliged in particular:
a) not to deliver and send information prohibited by law such as information propagating violence, defaming or violating personal rights and other rights of third parties,
b) to use the Online Shop in a way not interfering with its operation, in particular through the use of specific software or equipment,
c) to refrain from actions such as sending or posting in the Online Shop commercial information (spam) which was not ordered,
d) to use the Online Shop in a non-disruptive way for other Clients and the Seller,
e) to use any information submitted in the Online Shop for personal use only,
f) to use the Online Shop in a manner consistent with the applicable provisions in the Republic of Poland, the provisions of these Terms and Conditions as well as general principles of using the Internet.

IV. The procedure for the conclusion of the Sales Agreement
4.1. In order to conclude a Sales Agreement via the Online Shop you need to open the website www.granddeco.pl, select the product you are interested in and take futher steps in accordance with the messages displayed and information available on the website.
4.2. The choice of the Goods ordered by the Client is made by adding them to the shopping cart.
4.3. When placing orders - until you press the "Order" button - the Client may modify the submitted data and the selected Goods. In order to do it the Client needs to follow the displayed messages and information available on the website.
4.4. After filling in all the necessary data the summary list of the ordered products shall be displayed. This summary list shall contain the following information:
a) ordered products,
b) unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c) the chosen payment method,
d) the chosen delivery method,
e) time of delivery,

4.5. In order to send the Order it is necessary to accept these Terms and Conditions, provide personal information marked as mandatory and press the "Place Order" button.
4.6. By sending the Order by the Client, the Client declares intention to conclude the Sales Agreement with the Seller, in accordance with these Terms and Conditions.
4.7. Upon placing the Order, the Client shall receive an e-mail containing a final confirmation of all the essential elements of the Order.
4.8. The Agreement shall be considered as concluded from the time of receipt the above-mentioned e-mail.
4.9. The Sales Agreement is concluded in Polish / English / German / Czech / Slovak / French / Italian / Spanish with the content in accordance with these Terms and Conditions.

V. Delivery
5.1. Delivery of Goods is limited to the area of the European Union. The goods shall be delivered to the address indicated by the Client during the process of placing the Order.
5.2. The ordered goods are delivered by private transport, courier or post. Delivery costs depend on the target country of delivery and are listed in the "shipping costs" section on the main page of our Online Shop. In addition, the costs of delivery shall be indicated at the time of placing the Order.
5.3. The time of delivery takes from 5 to 10 working days from the date of placing the Order by the Client, depending on the country of delivery.
5.4. Clients can get access to these Terms and Conditions at any time via a link found on the main website as well as download and print the Terms and Conditions.
Recording, protecting, sharing and confirming the relevant provisions of the Agreement for the sale of Goods takes place by sending to the Client, at his e-mail and by attaching to the shipment, a printed confirmation, Order description or the VAT invoice.

VI. Prices and payment
6.1. The prices of Goods are expressed in PLN / EURO/ U.S. dollars and include all components such as VAT (with information about the VAT rate), customs duty and any other elements.
6.2. The customer shall pay the money:
a) by a bank transfer to a bank account number [...]
b) by PayPal,
c) the credit card - VISA, MASTER CARD
d) by PAYU.pl

VII. Permission to withdraw from the agreement
7.1. The Client, being a consumer within the meaning of the art. 221 of the Civil Code, has, on the basis of the provisions of law, the right to withdraw from the agreement concluded online without specifying reasons by making a declaration in writing within 10 days and sending it to the Seller’s address specified in these Terms and Conditions.
7.2. The 10-day term starts from the day in which the Goods or services provided by the Seller have been delivered.
7.3. The right to withdraw from the agreement by the consumer is excluded in the case of:
• commencing - upon customer’s consent - provision of services by the Seller before the expiry of 10 days from the conclusion of the agreement;
• musical and audiovisual recordings as well as computer programs stored on data carriers after removing their original packaging by the customer;
• agreements for services for which the price or remuneration depends solely on the financial market prices;
• goods (services) beyond the standard shop offer, prepared on special order of the Client and tailored to his individual needs;
• benefits, which, by their nature, can not be returned
• delivering the press
7.4. In the event of cancellation of the agreement concluded online, the agreement is considered null and void. What the parties rendered shall be returned in an unchanged state, unless the change was necessary within ordinary management. Reimbursement shall be made immediately, no later than within 14 days. The purchased goods shall be returned to the following address:

7.5. The Goods returned by the Client should be wrapped in an appropriate manner in order to ensure protection against damage to the consignment during transport.
7.6. The cost of packaging and returning the Goods shall be borne by the Client.

VIII. Complaints concerning Goods
8.1. LEDIT Sylwia Lechowska Advertising and Publishing Agency, as the Seller, is responsible for non-compliance with the Agreement for the sale of Goods purchased by the Client, who is a consumer within the meaning of the  art. 221 of the Civil Code, within the scope specified by the Act on the specific conditions of consumer sales.
8.2. Complaints arising from infringement of Client’s rights, which guaranteed by law or these Terms and Conditions shall be addressed at GrandDeco@granddeco.pl or ARW LEDIT - Poland, 62-080 Tarnowo Podgórne, Swadzim, ul.Ogrodowa 11
The Seller is obligated to examine any complaint within 14 days. If it is not possible, the Seller shall inform the Client about the date of examining the complaint within this period.
8.3. The Seller is not a manufacturer of goods. The manufacturer takes responsibility on account of providing warranty of the Goods sold in accordance with the conditions and period of time specified in the warranty card. If the warranty document provides it, the Client may make complaints in accordance with the warranty directly in the authorized service center, whose address is specified in the warranty card.

IX. Complaints on the provision of electronic services
9.1. The Seller shall take actions to ensure proper operation of the Online Shop to the extent resulting from the current technical knowledge and undertakes to remove any irregularities reported by Clients within a reasonable period of time,.
9.2. The Client shall immediately notify the Seller about any irregularities or interruptions in the operation of the Online Shop.
9.3. Any irregularities related to the operation of the Online Shop shall be submitted in writing to the address: ARW LEDIT - Poland, 62-080 Tarnowo Podgórne, Swadzim, ul. Ogrodowa 11 oraz by e-mail at
GrandDeco@granddeco.pl or by using the contact form.
9.4. The complaint shall include Client’s full name, correspondence address, type as well as date of irregularities related to the operation of the Online Shop.
9.5. The Seller is obligated to examine any complaint within 14 days. If it is not possible, the Seller shall inform the Client about the date of examining the complaint within this period.
X. Photos submitted on our website of the Online Shop
10.1 All photos submitted in the GrandDeco.pl Online Shop contitiue the property of the Seller and are protected by copyrights and related rights. Copying, processing and using images on other websites and auction sites is possible upon payment of the fee which amounts to 1000 EUR net (+ VAT 23%) for one photo. Publication of photos is equivalent to the acceptance of these Terms and Conditions and shall be the basis for the demand of payment for the used photos within 7 days from the date of their publication. Payment for use of photos shall be made to account number: PL61109013620000000113921995. Bank: BZ WBK SA SWIFT:  The VAT invoice shall be issued within 7 days from the date of booking the payment on the bank account.

XI. Final Provisions
11.1. Settlement of any disputes arising between the Seller and the Client, who is a consumer within the meaning of the art. 221 of the Civil Code, shall be subject to competent courts in accordance with the relevant provisions of the Code of Civil Procedure.
11.2. Settlement of any disputes arising between the Seller and the Client, who is not a consumer within the meaning of the art. 221 of the Civil Code, shall be subject to the court having the jurisdiction over the registered seat of AGC LEDIT Sylwia Lechowska - Poland, 62-080 Tarnowo Podgórne, Swadzim, ul. Ogrodowa 11
11.3. In matters not regulated herein, the provisions of the Civil Code, the provisions of the Act on Electronic Services and other relevant provisions of Polish law shall apply.
